All services by Quietech Associates, Inc. are provided with the following Terms of Service in place:
By requesting, authorizing, or receiving services from Quietech Associates, Inc., a California corporation, doing business as Quietech (“Quietech,” “we,” “us,” or “our”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. You authorize Quietech technician(s) to perform hardware and/or software services on your computer, device, or equipment (“Computer System”). You understand that Quietech technicians are trained to perform computer and device services; however, Quietech is not an authorized service dealer for any manufacturer. You acknowledge that technical support rendered by Quietech may void manufacturer warranties. You expressly waive all claims against Quietech for incidental or consequential damage to your Computer System or Data arising from authorized services, except as expressly stated in these Terms.
Abandonment: If you do not retrieve your Computer System within forty-five (45) days after notification that service is complete, it will be deemed abandoned. You agree to hold Quietech harmless for any claims or damages related to abandoned property. Upon abandonment, Quietech may dispose of, recycle, or resell the property at its sole discretion, to the extent permitted by law. All outstanding charges remain your responsibility.
Abuse: Quietech maintains a zero-tolerance policy for abusive, threatening, or disrespectful behavior toward staff. Quietech reserves the right to refuse or terminate service for such conduct.
Audio & Video Recording: Public areas are monitored for safety, training, and dispute resolution. By entering, you consent to recording. Private areas are not monitored.
BitLocker: Repairs, upgrades, and updates may trigger BitLocker or other encryption lockouts. These are security features built into the operating system and are not directly caused by Quietech. You are solely responsible for providing any required encryption or recovery keys. Quietech is not responsible for Data loss or delays resulting from missing or unavailable keys.
Estimated Completion Time: Any completion time provided is an estimate only. Unforeseen circumstances, including but not limited to parts availability, third-party delays, or additional required repairs, may affect completion time.
Hardware Replacement: If replacement parts are required, Quietech will obtain them upon your authorization. You are responsible for the cost of all parts. Removed parts will be returned to you upon prior request made at the time of authorization.
Impact of Upgrades: You are responsible for understanding the impact of operating system, application, or utility software upgrades. Upgrades may cause incompatibilities or Data loss, which may not be immediately apparent. You are responsible for confirming software compatibility with manufacturers prior to requesting upgrades. If an operating system must be reinstalled, Quietech will install the operating system and applicable updates only. All additional software, including but not limited to Microsoft Office, Quicken, QuickBooks, backup, and antivirus programs, is your responsibility.
Liability: Quietech’s liability for damage to your Computer System or Data is strictly limited to damage caused directly by Quietech’s negligent acts or omissions while services are being rendered. In no event shall Quietech’s total liability exceed the total amount paid for the services giving rise to the claim. You agree to release, indemnify, and hold harmless Quietech, its owners, employees, and agents from any and all claims, losses, damages, or expenses arising out of or related to services performed, except to the extent caused by Quietech’s gross negligence or willful misconduct. Certain repairs, including but not limited to virus, malware, and spyware removal, may damage software or Data and may require reinstallation of operating systems, programs, or Data at your expense.
Liquid Damage: Liquid damage is often irreversible and may cause ongoing or delayed failures due to corrosion. While Quietech will make reasonable efforts to repair liquid-damaged devices, no guarantees are made. Services performed on liquid-damaged devices are not warrantied, and charges apply regardless of outcome.
Loss of Data: You acknowledge that you are solely responsible for backing up all Data prior to service. Due to the nature of repair work, Data may be damaged or lost. Quietech is not responsible for Data loss under any circumstances. Data backup services may be requested for an additional fee; however, Quietech does not guarantee the success or completeness of any backup.
Ownership: You represent that you are the lawful owner of the Computer System or are authorized to approve service. Quietech will release the Computer System only to the owner unless otherwise authorized in writing. You must own and provide proof of ownership or licensing for any software installed or reinstalled, including required installation media, license keys, serial numbers, or account credentials.
Payment: Payment is due upon completion of services unless otherwise approved in writing. Quietech reserves the right to require deposits for products or services ordered in advance. Unpaid accounts are subject to collection, charged at a 10% interest fee every 30 days in compliance with California Law, and other legal remedies. A $2.50 paper billing fee will apply after 30 days of nonpayment. Accounts unpaid after 90 days will incur a collection fee of up to 30% or $75, whichever is greater, and may be referred to a collection agency, impacting your credit. Quietech may pursue payment through small claims court or other lawful means and may add up to $600 to cover court-related costs and time. Returned checks will have a $30 fee applied.
Privacy: Quietech technicians do not intentionally browse personal files; however, incidental access may occur as necessary to perform authorized services. You consent to such incidental access. Any contraband, illegal content, or suspected unlawful activity discovered during service will be reported to law enforcement.
Returns: Products may be returned within fifteen (15) days in new, unopened condition. Computers, and any other products that have been used or contain customer Data are subject to a 20% restocking fee. Returned special-order parts are subject to a 20% restocking fee, and some special-order parts are not returnable due to vendor policies, or may have higher return fees. Printers that have ink installed, routers, and hard drives (internal or external) are not returnable after purchase.
Right to Refuse: Quietech reserves the right, in its sole discretion, to refuse or discontinue service for work beyond its capabilities or for any other good cause.
Scope of Work: Quietech will perform only the services authorized at intake. Any additional work requires your approval prior to completion.
Warranty: Routine services are covered by a fifteen (15) day limited warranty. This warranty does not apply to services expressly waived by a signed Release of Liability, printer repairs, or to liquid-damaged devices. Quietech does not manufacture hardware components and provides no warranty on parts beyond those offered by the manufacturer. Quietech assumes no responsibility for voided manufacturer warranties.
Definitions: Computer system: Hardware, software, and connected devices. Data: Any non-OS information stored on the system or connected devices.
