Main Points:
· Minimum Charge of $75 for Diagnosis / Check-In
· We will call if the total is over $150 (unless flat-rate services were agreed upon)
· Your diagnosis and/or repairs will be completed within 48 hours (unless otherwise informed or parts are needed)
· You will receive a call when your repairs are completed or if additional information is needed
· Your item must be retrieved within 45-days or it will be treated as abandoned
· Payment is due upon pick-up / at time of service
· We charge a 3% surcharge for credit card payments
· 15-day work warranty on all repairs/services
All services by Quietech Associates, Inc. are provided with the following Terms of Service in place:
I authorize Quietech Associates, Inc. (dba “Quietech”) technician(s) to perform work on my computer/device. I understand that Quietech technicians have been trained to perform computer/device hardware and software work, but Quietech is not an authorized service dealer. Further, I agree to release, indemnify, and hold harmless Quietech from liability for any claims and/or damages of any kind or description that may arise from any work performed on my computer/device, unless it is caused by severe negligence of Quietech or its agent. I understand that technical support rendered by Quietech may void manufacturer warranties for this computer system/device. I expressly waive all claims against Quietech or any damages to this computer system/device or data that are incidental to the technical support rendered by Quietech. The liability of Quietech is strictly limited to those damages to this computer system/device or data that are due to negligence on the part of Quietech while technical support is being rendered.
Abandonment: If you do not pick up your equipment within forty-five (45) days after we notify you that the requested service is complete, we will treat your equipment as abandoned. You agree to hold Quietech harmless for any damage or claim for the abandoned property. Any and all charges are still your responsibility.
Estimated Completion Time: Quietech will provide an estimated completion time for your repair/install. Unforeseen circumstances, parts orders, etc. may have an impact on our ability to complete the repair(s) as provided in the estimate.
Hardware Replacement: If replacement parts are needed for a repair, we will obtain them at your request. You are responsible for the cost of any replacement parts needed. Any old parts/hardware will be returned to you when service is completed upon prior request (let us know when approving your parts order).
Impact of Upgrades: Please be advised that it is your responsibility to understand the impact of upgrades to the operating system, applications and utility software. Such upgrades can lead to incompatibilities and the possible loss of data/programs. Computer/device hardware and software work together and incompatibility may not become apparent until a later date. You are responsible for contacting the manufacturer of your software regarding compatibility issues BEFORE you request any upgrades. If the Operating System has to be replaced or reinstalled Quietech is responsible for installing the OS and all applicable updates. Any and all software beyond the Operating System is the responsibility of the user; this includes, but is not limited to, such software as MS Office, Quicken, QuickBooks, and anti-virus programs.
Liability: Quietech liability for damage to your computer/device is limited only to any damage which is determined to be caused by our negligent acts or negligent omissions. Our liability for repairs is limited to the total price of the repairs. Be aware that certain repairs, including but not limited to virus and spyware removal, may damage software and/or data installed on your computer/device. This is to be expected and may require the re-installation of your operating system, programs, and data, which would be your financial responsibility.
Loss of Data: Quietech assumes that you have already done an adequate backup to retain all of your important data. Due to the process of repair, data may get damaged, or at worst, deleted. Quietech is not responsible for the loss of any data which may occur while performing work on your system. You are responsible for backing up your own data. You may request that Quietech backup your data for you at an additional cost; however, we do not guarantee any backup.
Ownership: You must own the computer/device that you bring in for repair(s). Quietech will return the computer/device only to its owner when the repair(s) are complete unless otherwise stated by the owner. In the event that you are found not to be the true expressed owner of this computer system, you assume all liability for any claim made as the result of the technical support rendered by Quietech on this computer/device, including those claims which assert negligence on the part of Quietech. You must own and demonstrate ownership of any software that is to be installed or reinstalled on your computer/device by Quietech by bringing in the original software CDs/installation source, and the appropriate keys, serial numbers, and/or account login credentials to access your licensing.
Payment: We reserve the right to request a deposit for products and services ordered in advance. Fees for services rendered are due on completion of service. 30-day payment arrangements are available upon request and approval. Unpaid accounts are subject to collection, charged at a 5% interest fee every 30 days (in compliance with California State Law), and other legal remedies. If your account is unpaid after 30 days, a paper bill will be automatically sent at a charge of $2.50. If your account remains unpaid for 90 days, 30%, or $75, whichever is greater, will be added to the total amount due to cover collection costs, and the account will be sent to a collection agency. Your credit will be impacted. Should the account remain unpaid, we will pursue payment in small claims court, and add $960 to cover our time/fees in court.
Privacy: Our technicians will not browse through your hard drive/device looking at your data; however, they may inadvertently see data during the course of their work. Please remove any personal or private files you do not want others to see. Anything found to be contraband, illegal, or suspect of illegal activity will be immediately reported to law enforcement.
Returns: All products are covered by a 15-day return policy and must be returned in new condition in unopened packaging. Computers that have been used or had customer data stored, will have a $75 restocking fee applied to cover the removal and destruction of any data on the computer and prepare it for resale.
Right to Refuse: In its sole discretion, Quietech reserves the right to refuse work that it believes is beyond the scope of its ability or for any other good cause.
Scope of Work: Quietech will only perform the work agreed upon when you bring your computer/device in for repair. You must authorize any additional work which may be required.
Warranty: All routine services (not products) are covered by a 15-day warranty, unless you have requested a service that waives the warranty (Release of Liability form with signature required). Please alert us right away if you find a problem with the services you have been provided so we can make it right. All warranty repairs on physical components must be pursued through their manufacturers, as Quietech does not manufacture any components. Quietech does not assume any liability or warranty in the event that the manufacturer warranties are voided.
1. “Computer system” is defined as: Hardware (CPU enclosure, mouse, keyboard, printer, monitor and associated cables), software (operating system software, applications software and related software) and the additional physical devices specified in this document.
2. Data is defined as: Any information not part of the operating system software, applications system software or related software that is stored on the computer system/device described in this document or on any device that interacts with the computer system described in this document. This includes, but is not limited to cell phones, hard drives, etc.
